Congress could kill the lawsuit that threatens to wipe out the Affordable Care Act, legal experts say, but the politics of the issue will almost certainly keep it from doing so.
Three different legal experts offer ideas as to how Congress could make the entire lawsuit moot, if it wanted to:
Law professor Nicholas Bagley says that Congress could pass a law, signed by the president, stating that it believes the individual mandate is separable from the ACA. Legal expert and ACA supporter Tim Jost suggests that Congress could pass a $1 penalty for not having health insurance, essentially recreating its status as a (constitutional) tax. Conservative legal expert Jonathan Adler tells me that Congress could just repeal the health insurance requirement entirely. Yes, but: Doing any of these would require Republicans to act to save the ACA and Democrats to recognize the validity of the lawsuit.

Obama care is such garbage. I haven't met a liberal who understands how it works. They think it is universal healthcare.
It is a garbage pail policy, sold by a private insurance company FORCED to add things by the law.
It FORCES people to buy that product and as long as government workers and union workers keep their Cadillac policies nothing will change.
Many states have had insurance companies leave their states. My premiums tripled for example in one year.
You have to make less than $35K to get it basically for $100 a month BUT it must go through your tax return.
Poor people don't understand how it works and still simply rely on medicaid.
It is a fucking disaster that couldn't be worse.

The ACA lawsuit does away with it, NJ took to proactive legislation. I asked CPA what his opinion was concerning insurance companies being able to deny persons with pre-existing conditions.

People getting health insurance through work creates this problem. When they lose their job, they can't get insurance because of a preexisting condition. Its really THAT simple. Just like car insurance. All policies cost the same, universal insurance or all policies cost the same. Denial of pre existing vnditions is driven by all the jerk offs with NO insurance until they get sick. That can't stay but the ACA doesn't fix it. The ACA is the worst thing to happen to the business.

Explain to people that other people have to subsidize the cost of covering those people and lets see how popular covering pre-existing conditions really is. Most people like things until they learn the details. Thats why polling on Obamacare is so unreliable.

The fact that we have to pay for health insurance and higher education in this country is the only thing from keeping the real flood from happening.
