I also found the 15% off email from scout in my spam folder. Exactly where it belongs. I get that Ballbather had the right to sell off JI but he sure was doggy about the things he promised scout would and would not do. I remember him insisting that scout was not out to use our email addresses for marketing and as proof pointed out no emails had been sent. Unsurprisingly, as many said, the second the switch occurred the emails would begin. I have a hard time believing he didn't know that was a significant part of the acquisition. Does anyone have the original TOS from JI? Seems odd that Ballbather can just sell them to a third party for profit. Wouldn't the address holder need to approve the sale?

You would be better off targeting a violation of the TOS as a breach of contract but the TOS probably included JI's right to transfer ownership of the content--including user contact info--and to send occasional emails that include marketing its own services. If you ever went onto scout and set up your account there then you probably agreed to scout's TOS which no doubt include heavy rights to market the shit out of all of us. But really you have suffered no real injury here and even thinking about expending your time and money pursuing it would be an absolute waste.

And I understand JI owns posted content. But how do they have a right to sell the email address without approval? We signed up and agreed to the TOS on JI, not scout. I'm not looking for any compensation at all. I would just love for Ballbather to be forced to relinquish all those email addresses.

They didn't sell our email addresses. Most of us signed up over there under our own will. That's kind of the issue.

I believe Ballbather finally admitted that he did sell the addresses in one of the last threads over at JI. Then tried to back-peddle by saying all folks had to do was unsubscribe. Problem is that scout does not make it easy to unsubscribe.

I got the same email....I tried using their unsubscribe link but when I entered my email address it said that the email addy was unrecognized. I'm gonna go find Robert Pittman and shove my unsubscribe notice right up his ass. The people running scout were the original writers for The Prisoner. Or the ghost of Joseph Heller
