Schefter told Colin Cowherd Tuesday that he received a text from "somebody connected to the [Deflategate] story in some way" stating: "Brady's team is unreal I guess . . . Talented, big-name lawyers. Yee, Kessler, etc. Prediction = Won't miss a game." It's been long known that Brady's agent Don Yee would help defend his client as Brady continues to wade through the aftermath of the Wells Report's release. Yee has been on the offensive since last week. Kessler is a new addition, but his name is one that's well-known in NFL circles. He served as outside counsel to the NFLPA last year during the appeal of the NFL's indefinite suspension of Ray Rice. Twenty years ago he helped establish free agency in the NFL by winning the Freeman McNeil case and settling the Reggie White case that focused on restrictions of player movement. The lawyer who represented Patriots coach Bill Belidick back in 2000, when Belidick sued the NFL and the New York Jets in federal court to free himself from his contract with the Jets? That was Kessler, too. It's a high-profile addition for Brady as he prepares to appeal the four-game suspension he was handed on Monday -- one with a record of some pretty significant wins when it comes to battles with the league.

If they (mistakenly) thought the league had it in for them before their whiny response painting themselves as innocent victims of league victimisation, they ain't seen nothing yet.

Reminds me of Arod hiring that stuttering doosh Joe Tacopina to run his "I'm outraged" defense.
In the end, he basically just threw millions into the sh1tter and is now groveling as the new "aw shucks, happy to be here" Arod whilst Tacopina is on a 100' Yacht somewhere chuckling quietly to himself.
And, like Arod, being great at what he does is simply not enough.

He cannot controvert the fact that he withheld evidence and failed to cooperate. What I am hoping is sparklepony sues the league so they can do a formal and thorough discovery I would love to see what he is hiding.

Emails, texts, voice mails or whatever evidence there was has probably been destroyed. The P ats are better than the CIA. People act like you cant be found guilty on circumstantial evidence. That happens in criminal cases all the time where the burden of proof is much higher. Wells chose his words wisely b.c "more probably than not" is basically what his burden of proof was. He doesn't need to find a smoking gun. Those text messages are more than enough proof. The NFL might reduce the suspension just to try to make this all go away as fast as possible.

I've never gotten a court order for the forensic analysis of a phone, but I have for computers and emails don't disappear. I would imagine the same holds true for a phone. Not sure about text messages though. One thing for certain though....is if this goes to a real court and the court deems those text's emails etc relevant, they can easily get a subpoena for records from the phone company. At the very least, even if the text's were deleted and couldn't be retrieved, the phone company records would show that those text's were sent/received and phone calls were made. Brady would look even more guilty if it shows that he had 100 texts with the ball boys the week of the championship game and the week after and all of them were deleted. There is also the presumption of spoliation which basically says if you destroy relevant evidence the court (or the trier of fact) is allowed to presume that the evidence destroyed was detrimental to your position.

Someone (a lawyer) said before there was no way he'd win an appeal because it's not a personal conduct violation, it's a league rule violation which never gets overturned. That argument neglects to realize that this is the Patriots organizaton and specifically Tom Brady who we're talking about. His behavior reminds me exactly of how he behaves on the field scrapping for a loose fumble, never giving up. He is an entitled fuck. Ted Wells's fee is already over a million dollars. If the league wasn't out to get him before they will be now

At the end of the day I don't really care if he misses the 4 games or not. That's just legal bullshit now. The main thing is Brady and the Pats are forever officially astericked now in the eyes of the public. Nothing will change that.

There is always trace evidence with electronic communication somewhere the Flats are not omnipotent. In fact, the service provider keeps records in case there is an investigation and will turn over in compliance of a subpoena. Brady is digging himself in a much deeper hole.
