Last night, PFT surmised that free-agent kicker Jay Feely may have told Judge Richard M. Berman about the 2009 incident involving a Jets kicking ball during Feely’s unexpected trip to court in his capacity as a member of the NFL Players Association’s Executive Committee.
As it turns out, Feely did.
Appearing on The Doug Gottlieb Show, Feely said that he explained to Judge Berman the situation arising from a Jets-Patriots game.
“We talked about the similarities in that case and the differences in the way the NFL responded,” Feely said. “I didn’t get in trouble. I had no culpability in that case.”
As the kicker, Feely presumably would have been at least “generally aware” of the use of an unapproved piece of equipment by a Jets equipment employee, who was suspended as a result of the incident. But Feely was neither questioned nor disciplined.
It’s an important point, because the failure to investigate or to discipline Feely under similar circumstances shows that the NFL may have been acting arbitrarily in Brady’s case.
By Friday, we’ll find out whether Judge Berman agrees.

But two other things jump out: 1. One of the most underrated aspects of the entirety of Deflategate is that in 2006, based largely on the lobbying of Brady and Peyton Manning, the NFL agreed to let each team handle their own footballs during a game. This was an obvious mistake that would clearly backfire, as it did with Deflategate. But, as has been noted for months, the silence of other quarterbacks has been deafening. If some of them aren’t doing the same thing, then Tom Brady doesn’t have a handsome, dimpled chin. 2. Feely said Brady getting his own balls “was an issue to me at the time” and said something to the ball boy and received a smirk. When he brought it up with coaches, no one seemed to care. They saw it as an annoyance, not a horrible breach of football protocol. Like all of Deflategate, the pre-2006 allegations fit well into the “if you ain’t cheatin’, you ain’t tryin’.” But that’s still not an excuse for Brady. It’s like speeding. You can be driving down I-95 and see 10 cars pass you, flying by at 85 mph. Yet if the state trooper catches you going 78, you get, and deserve, a ticket. No defendant anywhere has ever been able to use the “yeah, well he does it too, so why am I in trouble” defense.

As long as the QB is throwing a football, any football, I couldn't give a shit about its air pressure. The Patriots best days are behind them. Their QB is getting old and they are ripe for a beating. It's time to beat them on the field with Brady or without Brady.

Once Gisele leaves Brady his confidence is going to go to shit and he will turn into Mark Sanchez.
