You asked what he should be charged with, and the ME ruled 'homicide', and I say he should be charged with homicide. That's all Two very big issues at play that have been completely lost on the drones in the streets is that homicide =/= a crime and a "chokehold" is not illegal (against NY penal code). You can call that nitpicking but IMO those are two very important distinctions in this case. Thankfully in a court of law people are forced to acknowledge those distinctions.

Assuming that lawful/accidental homicide is off the table. And is the African-American female sergeant - that was essentially supervising the arrest - included in the "morons" that should be indicted?
